Termination of sports contract: a study in the light of Gavaskar’s issue

Abstract:The Board of Control for Cricket in India, though a private body registered under Societies Registration Act, it was held as amenable to Writ Jurisdiction for discharging public functions. In the recent period, the BCCI has come to adverse notice of the Supreme Court for indulging in acts which are not in the interest of the game of cricket. This paper focuses on the reported decision of the BCCI in terminating the contract by not renewing the same. BCCI apart from considering the huge fees paid to Gavaskar is making allegations that he has failed to toe the line of the Board. In this context various legal issues have been discussed, particularly the Wednesbury’s doctrine. Suitable recommendations are made emerging out of the study, particularly to reconsider the decision of BCCI.
